Ukrenergo filed an appeal against the decision of the Kyiv District Administrative Court of June 27 to suspend the effect of NEURC Resolutions No. 954 and 955 of June 7, 2019, setting tariffs for Ukrenergo for the transmission and dispatch control services during the second half of 2019. The company also filed a petition with the court requesting to cancel the suspension of the said resolutions.
The NEURC has also officially stated its emphatic disagreement with the court decision to suspend the regulation Administrative Court of Kyiv has issued a decision to suspend the effect of the above-mentioned NEURC Resolutions, which set the tariffs for Ukrenergo at the request of JSC “Nikopol Ferroalloy Plant”. The enterprise is appealing to the Regulator, demanding to cancel the new tariffs of Ukrenergo because, i, they directly affect its property rights as a consumer of Ukrenergo services.
The head of Ukrenergo Vsevolod Kovalchuk said that the abolition of the company’s tariffs for the second half of 2019 will make Ukrenergo impossible to operate properly in the new market, which will inevitably affect its participants. The company will also not be able to compensate the costs of the guaranteed buyer for the payment of the “green tariff” to RES producers.
